Gestos and IPPF ACRO express their concern about the current position of the Brazilian government regarding guaranteeing the right to abortion, as established by law.

We join organizations expressing outrage at the maintenance of guidelines from the previous government, which, in an attack on the rights of people with uteruses, set a limit of 21 weeks and 6 days for legal abortion.

We reinforce that there is no gestational time limit for abortion in cases provided by law and that the SUS (Unified Health System) must attend to all individuals in need, without imposing limitations, without any prejudice or discrimination against those seeking the service.

We join organizations expressing outrage at the maintenance of guidelines from the previous government, which, in an attack on the rights of people with uteruses, set a limit of 21 weeks and 6 days for legal abortion.

What's happening?

On February 28th, the Ministry of Health published Technical Note No. 2/2024, revoking the previous government's regulation that imposed a time limit. However, there wasn't even time to celebrate, as the Ministry of Health's note was revoked, evidently under pressure from fundamentalist groups that are increasing their influence over public decisions day by day.

The official justification was that the document had not passed through all necessary spheres, so we demand promptness for its approval.

Brazil is a secular state, and civil society demands an end to this disrespect for the right of individuals with uteruses to access quality abortion services, remembering that the Penal Code, in force since 1940, does not establish any time limit for access to abortion under the conditions provided by law.

In Brazil, legal abortion is permitted in cases of pregnancy resulting from rape, risk to the life of the pregnant person, and fetal anencephaly. We need to expand legislation to guarantee the procedure to all individuals who claim to want it, and not, on the contrary, to increase existing barriers even further. We demand total respect for our reproductive rights and will not accept setbacks.
